Terms of Use Agreement
This Terms of Use Agreement ("Agreement") is entered into by and between Kate Salama, M.D., an LLC, and the user of the "Midlife Care & HRT for Psychiatrists Program" ("User").
By accessing and using the Midlife Care & HRT for Psychiatrists Program ("Program"), the User agrees to be bound by the terms and conditions set forth in this Agreement. If the User does not agree to these terms, they should not use the Program.
1. Program Access and Use
1.1 Eligibility: The User must be at least 18 years old to access or use the Program.
1.2 Account Information: The User agrees to provide accurate and complete information when creating an account and to update their information promptly to keep it accurate.
1.3 Program Rules: The User agrees to abide by all rules and guidelines provided within the Program.
2. Program Content
2.1 Intellectual Property: All content provided within the Program, including but not limited to text, graphics, logos, images, audio, and video, is the intellectual property of Kate Salama, M.D. and is protected by copyright laws.
2.2 Use Restrictions: The User may not modify, reproduce, distribute, create derivative works, publicly display, or otherwise exploit any content within the Program without the express written consent of Kate Salama, M.D..
2.3 Marketing of Course Material: All Zoom calls will be recorded and may be used as marketing material in the future. All reviews given through the program software, unless otherwise specified, can also be used for future marketing efforts.
3. User Conduct
3.1 Prohibited Activities: The User agrees not to engage in any of the following activities:
- Violating any applicable laws or regulations.
- Transmitting any unauthorized or unsolicited advertising or promotional materials.
- Interfering with the security or integrity of the Program.
You agree to defend and indemnify Kate Salama, M.D. and hold me harmless against any and all legal claims and demands, including reasonable attorney's fees, which may arise from or relate to your participation in the program, your use or misuse of the website, your breach of this Agreement, or your conduct or actions. You agree that we shall be able to select our own legal counsel and may participate in our own defense, if we wish.
3.2 Termination: Kate Salama, M.D. reserves the right to terminate or suspend User access to the Program at its sole discretion, without notice, for any conduct that Kate Salama, M.D. believes violates this Agreement or is harmful to other users or third parties.
4. Disclaimer of Warranties
The Program is provided "as is" without warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
5. Limitation of Liability
Kate Salama, M.D. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Colorado.
7. Data Loss
We do not assume or accept responsibility for the security of your account or content. You agree that your participation in the program is at your own risk.
8. No Refunds on Digital Products
Due to the nature of the Midlife Care & HRT for Psychiatrists Program and the immediate access provided to digital materials, resources, and proprietary content upon purchase, all sales of this program are final. We do not offer refunds, exchanges, or cancellations for any reason.
9. Changes to the Agreement
Kate Salama, M.D. reserves the right to modify or update this Agreement at any time, and such changes will be effective upon posting on the Program.
By using the Midlife Care & HRT for Psychiatrists Program, the User acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Agreement.
